Privacy Policy

Effective June 1, 2025

We at American Identity Group, LLC (“Company”, “we,” “us,” or “our”), value your privacy. This Privacy Policy (this “Policy”) outlines our practices with respect to information obtained when you visit our website, available at identimaxx.com (“Site”), and interact with us in connection to our products, services, apps, and websites (“Services”). This Policy explains how we collect, use, share, retain, and transfer your information. We also let you know your privacy rights and how to exercise them.

Some of the Services we offer require us to collect and process different information from what is described in this Policy. The following links provide further information on product-specific features:

1. What This Policy Covers

1.1 Personal Data. When we say “Personal Data” in this Policy, we mean information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked with you, directly or indirectly. Personal data does not include information that cannot be reasonably linked to you, information that is publically available; information that is lawfully obtained from federal, state, or local government records; and truthful information that is of public concern.

2.2 Sensitive Data. In certain jurisdictions, some of the Personal Data we receive may be classified as sensitive data. Please see our United States Regional Privacy Notice for more information.

2. Collection of Personal Data

We collect Personal Data about you from different sources as listed below:

2.1 Personal Data You Provide to Us
When you interact directly with us, we may collect Personal Data that you provide to us, including:

Account Data. If you create an account with us, we collect identifiers, such as your name, mailing address, email address, phone number, user credentials (login name and password), and depending on the product purchased may also collect child name and age, emergency contact information, and location identifying labels (such as “home” or “school,” as defined by parent), driver’s license, and date of birth, as well as your audio, electronic, visual, or similar information, such as your picture (or avatar, if chosen).

Supplemental Identification Information. We collect your date of birth, age, and gender, as well as identifiers, such as your address, email, bank account information, credit/debit card information, mother’s maiden name, insurance information, and other personal details about you, such as your Social Security Number and/or state/government identifier, driver’s license number or other national personal identifier to verify your identity and to provide identify theft monitoring and protection services.

Financial Information. If you complete a purchase for one of our Services, we collect your billing address, including credit card, debit card, and/or PayPal payment data, National ID (region specific, if outside the United States), and VAT/Tax ID (regional specific, if outside the United States), as well as commercial information, such as information about the items you have purchased.

Communications. If you contact us directly, we collect personal data about you, including identifiers, such as your name, email address, phone number, the contents of any message or attachments that you may send to us, and any other information you choose to provide. We may retain and review audio, electronic, visual, or similar information, such as audio call and chat recordings and/or the contents of the messages as required/permitted by law and our recording and information management policies. We will also collect identifiers from you, such as your email address and phone number, when you sign up to receive product updates, offers, and other promotional information or messages from us. When we send you emails, we may track whether you open them to learn how to deliver a better customer experience and improve our Services.

Additional Information You Submit to Us. Information provided through forums, websites, and related information services.

2.2 Personal Data Collected Automatically

When you visit and use our websites and Services, we may automatically collect data about your interaction with our websites and Services, including:

App, Browser, and Device Information. We collect information to facilitate installation and use of our products, including information about the device, operating system, and browser you are using; other device characteristics or identifiers; and IP address.

Product Usage Information. This can include information about what you view or click on while using our Services and information about how our Services are performing when you use them.

Location Information. Information related to actual or relative physical location. When you use our Services, if you consent via the device interface to sharing the precise geolocation data of your device, we will receive your precise location information. We also infer your more general location information (for example, your IP address or time zone may indicate your more general geographic region).

Security Data. This data may include financial transactions, alert data, and data that is collected for cyber threat intelligence, as needed to provide cyber safety and identity threat protection Services. This data can include URLs and websites visited, executable files identified as malware, application names and versions, your interface and screen activity, and search terms. This data can also include device fingerprint ID from third parties to validate and authenticate payment and transaction information related to billing on accounts.

Website Data. When you browse our websites and Services, we automatically collect internet or other electronic network activity information, commercial information, and inferences drawn from personal information about the individual web pages or products that you view, the purchases you make, what websites or search terms referred you to our Services, the dates and times of your visits, and other information about how you interact with our Services. When you browse our websites and services, we may collect personal data using cookies and similar technologies (e.g., web beacons).Please see the Cookies and Other Tracking Technologies section below.

2.3 Personal Data Obtained from Affiliates, Service Providers, and Third Parties

Affiliates. We may obtain information, such as Supplemental Identification Information and Financial Information, from entities that, directly or indirectly through one or more intermediaries, control, are controlled by, or are under common control by the Company (“Affiliates”).

Service Providers. We may obtain information from entities that we and/or Affiliates form agreements with to provide Services (“Service Providers”). This information includes Personal Data obtained from:

    • Credit reporting agencies and financial institutions (used for purposes such as identity theft protection Services);
    • Enrollment information from your employer (when enrolled with our Services as an employee benefit);
    • Marketing and joint-marketing partners (used for purposes such as to offer Services and/or joint Service bundles to prospective members);
    • Data analytics providers (used for purposes such as improving the functionality and effectiveness of our Services); and
    • Private sources for purposes of providing customers with alerts related to financial transactions, property title, social media abuse, and other types of alerts within our products.

Third Parties. We may obtain information from people and entities that we do not have a direct business relationship with (“Third Parties”). This information includes Personal Data obtained from public sources such as the dark web to alert you to potential misuse of your personal data; and

Public Database Information. We may obtain information about you from public databases, such as the United Nations Sanctions List, US ITA Consolidated Screening List, and the SEC EDGAR, including your name, address, email address, phone number, gender, national ID number and nationality/country of residence, date of birth, job role, public employment profile, listing on any sanctions lists maintained by public authorities, and other data as necessary.

We may combine Personal Data from our Affiliates, Service Providers, and Third Parties with Personal Data we already have about you, to provide you with more relevant communications and to better tailor our Services to you. We make reasonable efforts to verify that all parties we work with are reputable, and we do not ask them to disclose your Personal Data if we do not have a lawful purpose and valid legal basis to collect and process that data.

3. Using Personal Data

We use your Personal Data to deliver, personalize, operate, improve, create, and develop our Services, to provide you with a secure, smooth, efficient and customized experience, and for legal compliance, loss prevention, and anti-fraud purposes. 3.1 Providing Company Services. We may use Personal Data to provide you with the Services you have requested.

3.2 Personalizing Company Services. We may use Personal Data to assess and understand interests and preferences to provide personalized experiences when using Services.

3.3 Business Intelligence and Analytics. We may use Personal Data to understand aggregate usage of and across Services; to accurately count people and businesses; and to validate metrics directly related to these.

3.4 Anonymizing Information. We may use Personal Data to anonymize data we have associated with you.

3.5 Improving Company Services. We may use Personal Data to improve product direction and development, which may include using Personal Data to train machine learning models.

3.6 Marketing and Promotions. We may use Personal Data to promote and advertise Company, Affiliates, Third Parties, and Services.

3.7 Authentication, Integrity, Security, and Safety: We may use Personal Data to authenticate accounts and activity; detect, investigate, and prevent malicious conduct, fraudulent activity or unsafe experiences; address security threats; protect public safety; and secure the Services.

3.8 Communicate with You. We may use Personal Data to communicate with you about Services, including product/service updates and changes to our policies and terms. We also use your Personal Data to respond to you when you contact us.

3.9 Legal Reasons. We may use Personal Data to comply with applicable law or respond to valid legal process, including from law enforcement or government agencies, to investigate or participate in civil discovery, litigation, or other adversarial legal proceedings, protect you, us, and others from fraudulent malicious, deceptive, abusive, or unlawful activities, and to enforce or investigate potential violations of our Terms of Service or policies.

3.10 Informed Consent. We may use Personal Data for any additional purpose provided that we have first obtained your informed consent for such purpose.

4. Sources of Disclosure

We work with Affiliates, Service Providers, and Third Parties to help us provide our Services and, as a result, we need to share certain information with these parties. Learn more about how and why we disclose your Personal Data:

4.1 You. We may disclose Personal Data back to you. For example, we may provide you with personalized marketing materials to use in sales pitches or provide you with a list of your Personal Data in response to a data request.

4.2 Affiliates. We disclose Personal Data to Affiliates. For example, we may provide Personal Data to an Affiliate to ensure a consistent and integrated user experience.

4.3 Service Providers. We disclose Personal Data to Service Providers. For example, we may provide Personal Data to a Service Provider to facilitate payments or provide customer support.

4.4  Third Parties. We may disclose Personal Data to Third Parties. For example, we may provide Personal Data to potential investors and advertisement agencies when they visit a Company profile.

4.5  New Owners. We may disclose Personal Data with actual or prospective acquirers, their representatives and other relevant participants in, or during negotiations of, any sale, merger, acquisition, restructuring, or change in control involving all or a portion of our business or assets, including in connection with bankruptcy or similar proceedings.

5. Cookies and Other Tracking Technologies

Third parties, including Google and Facebook, may use cookies, web beacons, and other technologies to collect or receive information from our websites and use that information to provide analytic services and targeted ads. You can opt-out of the collection and use of information for ad targeting using the options described in the Opting Out section below. The tracking technologies we utilize include the following

5.1 Cookies. We may use different types of cookies when providing different types of web-related services. If you do not know what cookies are, or how to control or delete them, then we recommend you visit www.aboutcookies.org for detailed guidance. Cookies allow us to identify and authenticate visitors, track aggregate behavior, and enable important service features. We use both session ID cookies and persistent cookies. Session ID cookies are used to maintain your browser state as you browse through services, and they expire when you close your browser. A persistent Cookie remains on your hard drive for an extended period, and we use that to identify you should you return to services and want to find information you had previously entered or accessed.

We may also contract with analytics services, third-party affiliate services, and third-party advertising companies to collect similar information. These cookies allow the ad servers to recognize your computer each time they send you an online advertisement, and compile information about you or others who use your computer. This information allows such advertising networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you.

5.2 Web Beacons/Tags. We may automatically collect aggregate anonymous information through files embedded in our services and emails known as “web beacons.” We may deliver a web beacon to you through our services from an advertising network with which we have contracted. Web beacons allow third parties to provide anonymized and aggregated auditing, research, and reporting for us. Web beacons also allow us to tell whether email recipients are able to properly view messages or if email messages have been opened, to ensure that we are sending only messages that are of interest to our users. We may use this information to reduce or eliminate messages sent to users. We do not tie the information gathered by web beacons to Personal Data.

5.3 Flash LSOs. When we post videos, third parties may use local shared objects, known as “Flash cookies,” to store your preferences for volume control or to personalize certain video features. Flash cookies are different from browser cookies because of the amount and type of data collected and how the data is stored. The cookie management tools provided by many popular browsers will not remove Flash cookies. 5.4  Analytics. We may use analytics tools or similar tools provided by third parties (“Data Analytics Providers”) to help analyze how you and other users utilize our services. Analytics tools use cookies and other tracking technologies to collect information such as how often users visit our website, what pages they visit, and what other websites they have used prior to visiting our website. We use the information we get from analytics tools only to improve services. Analytics tools collect the IP address or other unique identifier assigned to you on the date you visit our services. Analytics tools provided by third parties plant a persistent cookie on your web browser to identify you as a unique user the next time you visit our website, and the treatment of that information is governed by the third party’s terms of use and/or privacy policy. BY USING OUR WEBSITE, YOU UNDERSTAND AND AGREE THAT YOUR DATA WILL BE SHARED WITH THESE PROCESSORS, AND THAT THE PROCESSORS MAY SHARE YOUR PERSONAL DATA WITH THEIR PARTNERS. If you do not agree, you should immediately discontinue use of the Services.

6. Privacy Rights and Choices

6.1 Your Privacy Rights. Depending on where you live and subject to certain exceptions, you may have some or all of the following rights:

6.1.1 Right to Know: The right to request that we disclose to you the Personal Data we collect, use, or disclose, and information about our data practices.

6.1.2 Right to Request Correction: The right to request that we correct inaccurate Personal Data that we maintain about you.

6.1.3 Right to Request Deletion: The right to request that we delete your Personal Data that we have collected from or about you.

6.1.4 Right to Opt Out of Targeted Advertising: The right to opt out of the processing of your Personal Data for purposes that may be considered “targeted advertising” under applicable U.S. privacy laws, including information obtained from your activities on nonaffiliated websites or online applications.

6.1.5 Right to Withdraw Consent: You have the right to withdraw your consent to our collection, use, and disclosure of your Personal Data to the extent permitted by law and our contractual obligations.

6.1.6 Right to Data Portability: You have the right to ask us to provide you with a copy of your Personal Data in a structured, commonly-used format.

6.1.7 Right to Non-Discrimination: The right not to receive discriminatory treatment for exercising your privacy rights.

6.1.8 Right to Appeal: The right to appeal our decision if we decline to process your request.

6.2 Exercising Your Data Rights. In order to exercise any of your rights as to Personal Data controlled by us, please email us at customerservice@identimaxx.com or contact us at (800) 889-3191. Where legally permitted, we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, or jeopardize the privacy of others. Your request to delete Personal Data and withdrawal of consent to the collection, use and disclosure of your Personal Data may prevent us from providing you, or continuing to provide you, with some Services, the ability to access certain Services, and information that may be of value to you. We will act on your instructions as quickly as possible but there may be certain uses of your information that we may not be able to stop immediately or that may have to continue after your consent withdrawal, as required by applicable law. You may also take steps to affect your Personal Data by visiting your account and modifying your Personal Data directly.

7. Other Ways to Limit the Use of Personal Data

7.1 Unsubscribe from Emails and Other Communications. If you provide us with Personal Data and, thereafter, do not want to continue to receive further notices or information from us, such as emails about our products or services, you may unsubscribe using the link at the bottom of our emails.

7.2 Limit Use of Cookies and Other Web-Based Tracking Technologies. You can prevent certain cookies and technologies from being used by adjusting the settings on your browser or by electing your preferences in the window that appears when you visit the website. Be aware that disabling cookies will affect the functionality of this website and many other websites that you visit.

7.3 Limit Collection of Geo-Location Data. You may be able to prevent your device from sharing precise location information, including without limitation some or all of your Geo-Location Data, at any time through your device’s operating system settings

7.4 DO NOT TRACK. Some browsers have a “DO NOT TRACK” feature that lets website users inform websites or other applications that they do not want to have their online activities tracked. These “do not track” features may also give website users other choices regarding the collection of their personal identifiable information. However, these “do not track” features and “do not track” signals are not yet uniform. ACCORDINGLY, EACH USER OF THE WEBSITE OR ANY OTHER PRODUCTS/SERVICES IS HEREBY NOTIFIED THAT THE WEBSITE AND THE PRODUCTS/SERVICES ARE NOT CURRENTLY SET UP TO RESPOND TO ANY OF THE USER’S “DO NOT TRACK” FEATURES OR “DO NOT TRACK” SIGNALS.

8. How We Store Personal Data

8.1 Data Retention. We keep Personal Data for as long as we need it to provide Services requested by you, comply with legal obligations, or protect our or other’s interests. We decide how long we need information on a case-by-case basis.

8.2 Factors Considered. These are the factors that we take into account:

8.2.1  If we need it to operate or provide Services

8.2.2 The Services we use it for, and how they work.

8.2.3 How long we need to retain the information to comply with certain legal obligations.

8.2.4 If we need it for other legitimate purposes, such as to prevent harm; investigate possible violations of our terms or policies; promote safety, security and integrity; or protect ourselves, including our rights, property or services/products.

9. Third-Party Sites

The Services may now or in the future link to other websites, forums, or programs that are not under our control and are not owned by us or Affiliates (collectively referred to as “Third-Party Sites”). Any link to any Third-Party Site from Services does not imply any endorsement of the privacy practices of the Third-Party Site. No Third-Party Site is authorized to make any representation or warranty on our behalf.

If you click on a link to, or otherwise gain access to, any such Third-Party Site, you will be transported to one of these Third-Party Sites. 

This Policy only applies to the Services. This Policy: (a) does not describe the privacy policies of any of these Third-Party Sites; and (b) does not govern the collection or use of your Personal Data by the Third-Party Sites. We are not responsible for the privacy practice of any of these Third-Party Sites. You should review the privacy policies for any Third-Party Sites to determine their practices with respect to the collection and use of Personal Data.

You acknowledge and agree that, by clicking a link to or otherwise accessing a Third-Party Site, your Personal Data may be read, collected, shared, distributed, or otherwise used by the Third-Party Site. We are not responsible for any Personal Data that you submit, or otherwise make available, to Third-Party Sites.

10. Children’s Privacy

We do not have knowledge that we sell the Personal Data of anyone who is under the age of sixteen (16) without their affirmative consent. We do not collect the Personal Data of anyone under the age of thirteen (13). If we learn that we have collected or received Personal Data from individuals under the age of thirteen (13), we will follow the required legal process, and then we will delete the Personal Data. If you believe we have Personal Data on individuals under the age of thirteen (13), please contact us at the contact information provided below.

11. Data Security

To protect your Personal Data, we take reasonable precautions and follow industry best practices to make sure it is not lost, misused, accessed, disclosed, altered or destroyed.

We reserve the right to modify this Policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on this website.
